1. Definitions
Affiliate: An entity that controls, is controlled by, or is under common control with a party (control means at least 50% voting power or the ability to direct management).
Agreement: These Terms & Conditions and referenced policies (including the Privacy Policy and Refund Policy contained here).
Beta Services: Features labeled alpha, beta, preview, early access, or similar.
Customer Data: Information you submit to Hinto (e.g., account email, billing details). Meeting content is not transmitted to us.
Restricted Data: Sensitive data (health, financial account numbers, government IDs, minors’ data, or other regulated data) that you must not submit to Hinto.
Services: The Hinto desktop application and related website.
Software: The Hinto desktop client provided as part of the Services.
Usage Data: Diagnostic and operational data about performance and basic usage (not meeting content).
Merchant of Record: Gumroad, which processes payments and collects applicable taxes.
Capture: A single on-demand request you make within the Hinto desktop application to receive AI-generated guidance or assistance. Each time you trigger the Hinto assistant to analyze content and provide suggestions during a meeting, this counts as one capture. Your license includes unlimited lifetime captures, but capture count is used to determine refund eligibility (see Refund Policy).
Lifetime License: A perpetual, non-expiring license to use the Hinto software version available at the time of purchase, including feature updates and security patches that Hinto chooses to release. 'Lifetime' refers to the life of the product, not the life of the user. Hinto does not guarantee that the product will be maintained, supported, or compatible with future operating systems or platforms indefinitely. Hinto may discontinue the product at any time, in which case your license continues for the last released version but no further updates will be provided.

Alternative Dispute Resolution: The European Commission provides a platform for online dispute resolution (ODR) available at https://ec.europa.eu/consumers/odr. Hinto.dev is not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board, except where required by law.
3. Acceptance of Terms
Hinto.dev (“Hinto”, “we”, “us”), based in Germany, provides a desktop AI assistant for technical meetings and this website. By installing, accessing, or using Hinto, you agree to these Terms & Conditions. If you do not agree, do not use the product.
We may update these terms to reflect product, legal, or security changes. Material updates will be posted here with a new effective date. Continued use after the effective date constitutes acceptance.
4. Service Overview and License
Hinto is a locally running desktop assistant that overlays guidance during technical meetings. It does not join calls as a participant. Captures are on-demand snippets you trigger to get help.
Your purchase grants a personal, single-user lifetime license, feature updates, and access to support via info@hinto.dev. The software is licensed, not sold. You remain responsible for what you say and share.
You must be at least 18 and able to enter a binding contract. Keep device security up to date and do not share keys or access.
5. Acceptable Use
Use Hinto only for lawful purposes and with content you are authorized to access. Comply with employer/client and meeting-platform policies.
Prohibited: reverse engineering; reselling or sublicensing; automating access via bots or scrapers; interfering with security; submitting malware; or using Hinto to violate others’ rights or applicable law. We may suspend access to protect the service or comply with legal obligations if misuse is detected.
6. Payments, Pricing, Merchant of Record
Hinto is sold as a one-time purchase. Prices may change; the price shown at checkout (and on hinto.dev/#pricing) is the price that applies to your order, plus any applicable taxes calculated by Gumroad.
Gumroad acts as the merchant of record and handles payment processing, invoicing, and applicable taxes on our behalf. Your purchase is subject to Gumroad's terms of service.
7. Refund Policy and Right of Withdrawal
Right of Withdrawal (EU/EEA/UK Consumers): If you are a consumer in the European Union, European Economic Area, or United Kingdom, you have the right to withdraw from this purchase within 14 days of purchase without giving any reason, subject to the exception for digital content described below.
Exception for Digital Content: Under EU Consumer Rights Directive Article 16(c) and equivalent national laws, you lose your right of withdrawal for digital content if you give your express prior consent to immediate delivery and acknowledge that you thereby lose your withdrawal right once performance begins. By purchasing Hinto, you are providing this express consent and acknowledgment.
Immediate Performance and Consent: When you complete your purchase through Gumroad, you consent to immediate access to the Hinto software. By completing your purchase, you expressly request immediate performance (delivery and activation of your license) and acknowledge that you will lose your right of withdrawal once you begin using the software.
Usage-Based Refund Policy: Notwithstanding the above, Hinto offers a voluntary refund policy beyond legal requirements: We will issue a refund if both conditions are met: (1) your request is made within 14 days of purchase, and (2) your license key has been used for fewer than 20 captures (on-demand help requests) as recorded in our system.
Full Delivery Definition: Once your license key has been used to process 20 or more captures, the digital content is considered fully delivered and utilized, and the license becomes non-refundable under our voluntary policy. This does not affect mandatory consumer rights under applicable law.
Refund Request Process: To request a refund, email info@hinto.dev with the email address used at checkout, your order receipt or license key, and the reason for your request. We will verify your usage count and process eligible refunds within 14 business days to the original payment method via Gumroad.
Statutory Consumer Rights Preserved: This voluntary policy does not limit any mandatory consumer rights under applicable law, including statutory warranty rights, consumer protection laws, or rights that cannot be waived by contract. If mandatory law provides greater rights than this policy, those rights apply.
Non-EU Users: If you are not located in the EU, EEA, or UK, the 14-day withdrawal right does not apply, but our voluntary usage-based refund policy (14 days and fewer than 20 captures) remains available unless prohibited by local law.
8. Service Changes & Availability
We may update or improve Hinto (including security updates and feature changes). We may suspend or limit access to protect the service, comply with law, or address misuse.
9. Suspension & Termination
We may suspend or terminate access for misuse, security risk, non-payment, or legal compliance. We will limit suspension to what is reasonably necessary and reinstate access once the issue is resolved where appropriate.
If terminated for breach or misuse, no refund is owed. Your statutory rights (including any mandatory withdrawal rights) remain unaffected.
10. Privacy, Data, and Security
We operate with a privacy-first approach. Data practices are described in our Privacy Policy, which is incorporated into these terms. Do not submit Restricted Data.
We do not sell data or use advertising trackers. We use Vercel Analytics on our website and rely on Gumroad for payments. Meeting content remains on your device; we do not transmit or store it. Usage Data is limited to diagnostics needed to operate the service.
11. Intellectual Property Rights and Responsibilities
Hinto's IP Rights: Hinto.dev and its licensors retain all intellectual property rights in the Hinto software, AI models, algorithms, branding, user interface, documentation, and all other components of the service. Your license is limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable in accordance with these Terms.
Your Inputs: You retain ownership of any content you input into Hinto (such as account information or support communications). By providing inputs, you grant Hinto a limited license to use them solely to provide and improve the service, provide support, and comply with legal obligations.
AI Training Data Disclaimer: Hinto's AI models are trained on large datasets that may include publicly available code, documentation, and other content from various sources. While Hinto uses commercially reasonable efforts to train models legally and ethically, we cannot guarantee that all training data was licensed, authorized, or free from third-party intellectual property rights.
AI Outputs and Third-Party IP Risks: AI-generated code, technical solutions, algorithms, or other outputs may be similar to, derived from, or identical to content created by third parties, including content protected by copyright, patents, trade secrets, or other intellectual property rights. AI outputs may also be subject to open-source licenses (GPL, AGPL, MIT, Apache, etc.) that impose obligations on users, such as attribution, source code disclosure, or license propagation.
No IP Clearance or Indemnification: HINTO PROVIDES NO REPRESENTATION, WARRANTY, OR GUARANTEE THAT AI OUTPUTS ARE FREE FROM THIRD-PARTY INTELLECTUAL PROPERTY CLAIMS. Hinto does not perform intellectual property clearance, freedom-to-operate analysis, or patent searches on AI outputs. Hinto will not defend or indemnify you against any third-party claims that your use of AI outputs infringes intellectual property rights.
Your Responsibility for AI Output Use: YOU ARE SOLELY AND EXCLUSIVELY RESPONSIBLE for determining whether AI outputs are appropriate for your intended use, conducting your own IP clearance and freedom-to-operate analysis, complying with all applicable open-source licenses, and obtaining any necessary permissions or licenses from third-party rightsholders. You assume all risk of third-party IP infringement claims arising from your use of AI outputs.
License Compliance: If you use AI-generated code or content in your projects, you are responsible for identifying and complying with all applicable open-source licenses, proprietary licenses, attribution requirements, and other intellectual property obligations. Failure to comply with these obligations may subject you to legal liability, and Hinto expressly disclaims all responsibility for such failures.
Prohibited Uses: You may not reverse engineer, decompile, disassemble, or attempt to derive the source code of Hinto's software or AI models. You may not use Hinto to build competing products or services. You may not extract, copy, or repurpose Hinto's AI models, training data, or proprietary algorithms.
Trademark: 'Hinto' and associated logos are trademarks of Hinto.dev. You may not use our trademarks without prior written permission.
12. AI-Generated Content: Limitations, Risks, and User Responsibility
IMPORTANT DISCLAIMERS ABOUT AI OUTPUTS: Hinto uses artificial intelligence to generate responses and suggestions. You must understand and accept the following limitations before using the service:
Accuracy and Reliability: AI outputs may contain factual errors, outdated information, logical flaws, security vulnerabilities, or completely fabricated content (hallucinations). AI does not verify its outputs against current, accurate sources. You must independently verify all information before relying on it.
No Professional Advice: Hinto does not provide professional career coaching, technical consulting, legal, financial, or any other professional advice. AI outputs are generated by algorithmic processes, not human experts. Do not treat AI suggestions as authoritative or expert guidance.
Technical Content Risks: Code, algorithms, technical solutions, or architectural suggestions provided by AI may be inefficient, insecure, non-functional, or violate best practices. They may also infringe third-party intellectual property rights (see Intellectual Property section). Always review, test, and validate technical content before use.
Bias and Inappropriate Content: AI models may reflect biases present in training data or generate inappropriate, discriminatory, offensive, or harmful content. Hinto is not responsible for the substance of AI outputs. You are solely responsible for reviewing outputs for appropriateness before sharing them.
Interview and Employment Outcomes: Hinto provides no guarantee, warranty, or assurance regarding interview performance, job offers, employment outcomes, career advancement, or any professional results. Your interview success depends on numerous factors entirely outside Hinto's control, including your qualifications, preparation, communication skills, interviewer preferences, company needs, and market conditions. Using Hinto does not improve your chances of employment.
Employer Policies and Academic Integrity: Many employers, educational institutions, and professional organizations consider real-time AI assistance during interviews or examinations to be cheating, dishonest, or a violation of academic/professional integrity codes. Use of Hinto may violate your employment agreement, employee handbook, academic honor code, professional ethics rules, or examination policies. You are solely responsible for determining whether use of Hinto complies with all applicable policies and codes of conduct. Hinto explicitly disclaims all liability for employment termination, academic discipline, professional sanctions, or reputational harm resulting from your use of the service.
Meeting Platform Terms: Video conferencing platforms (Zoom, Microsoft Teams, Google Meet, etc.) have terms of service that may prohibit automated tools, screen capture, recording, or third-party integrations. Platform providers may update their terms, implement technical restrictions, suspend accounts, or terminate service for users of tools like Hinto. You are solely responsible for compliance with platform terms. Hinto does not guarantee compatibility with any platform and is not responsible for account restrictions or terminations imposed by platform providers.
ASSUMPTION OF RISK: BY USING HINTO, YOU EXPRESSLY ACKNOWLEDGE AND ASSUME ALL RISKS associated with relying on AI-generated content, including but not limited to: providing incorrect information in interviews, violating employer or platform policies, facing academic or professional discipline, losing employment opportunities, reputational harm, and any other consequences of using AI assistance. You agree that your use of Hinto is entirely at your own risk.
WAIVER OF CLAIMS: To the maximum extent permitted by law, you waive and release any and all claims against Hinto.dev, its officers, directors, employees, contractors, and affiliates arising from or related to: (a) AI output accuracy, quality, or suitability; (b) interview performance or employment outcomes; (c) employer, academic, or platform policy violations; (d) employment termination or professional discipline; (e) missed opportunities or career harm; and (f) reliance on AI-generated content.
AS IS BASIS: Hinto and its Services are provided on an 'as is' and 'as available' basis without warranties of any kind, to the fullest extent permitted by law.
13. Limitation of Liability
DISCLAIMER OF CERTAIN DAMAGES: TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL HINTO.DEV, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS (COLLECTIVELY, 'HINTO PARTIES') BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF HINTO, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
This disclaimer specifically includes but is not limited to liability for: (a) lost profits, revenue, business opportunities, or employment opportunities; (b) job offers not received, interviews failed, or employment termination; (c) loss of data, goodwill, reputation, or business relationships; (d) career setbacks, missed promotions, or professional advancement delays; (e) costs of procurement of substitute services or technology; (f) business interruption; (g) personal injury or emotional distress (except where prohibited by law); (h) reliance on AI outputs or guidance; and (i) third-party claims arising from your use of Hinto.
CAP ON DIRECT DAMAGES: TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF HINTO PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF HINTO WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO HINTO FOR YOUR LICENSE (EUR 169 OR EQUIVALENT).
This liability cap applies regardless of the number of claims, the theory of liability, or the forum in which claims are brought. It applies separately to each user and is not aggregated across multiple users.
Mandatory Liability Preserved: Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including: (a) liability for death or personal injury caused by gross negligence or willful misconduct of Hinto.dev; (b) liability for fraud or fraudulent misrepresentation; (c) liability for breach of mandatory consumer protection rights that cannot be contractually waived; or (d) any other liability that cannot be excluded under German law (including BGB § 309 Nr. 7) or other applicable consumer protection laws.
In jurisdictions where limitation of liability for gross negligence is permitted, such limitations apply to the fullest extent permitted. In jurisdictions where such limitations are prohibited, they apply only to ordinary negligence.
Time Limitation on Claims: Any claim or cause of action arising out of or relating to your use of Hinto or these Terms must be filed within one (1) year after the claim or cause of action arose, or it will be permanently barred, to the extent permitted by law. This does not affect mandatory statutory limitation periods that cannot be shortened by contract.
Acknowledgment: You acknowledge that the fees charged by Hinto reflect this allocation of risk and limitation of liability, and that Hinto would not offer the service at the current price without these limitations.
14. Indemnity
You agree to indemnify and hold harmless Hinto.dev against claims and costs arising from your unlawful or unauthorized use of Hinto, or from violations of these terms.
15. Force Majeure
Neither party is liable for delays or failures caused by events beyond reasonable control (including natural disasters, war, government action, or internet disruptions). Payment obligations are not excused.
16. Governing Law & Venue
These terms are governed by the laws of Germany. If a dispute arises, the courts of Germany will have jurisdiction, except where mandatory consumer protections provide otherwise.
If you are an EU consumer, you may be entitled to use the EU Online Dispute Resolution platform; using it is optional and does not limit your rights.
17. Dispute Resolution and Arbitration
Informal Resolution: Before initiating any legal proceeding, you agree to first contact us at info@hinto.dev to attempt to resolve the dispute informally. We will attempt to resolve disputes within 30 days.
Arbitration Agreement (Non-EU Users): If you are not a resident of the European Union, European Economic Area, United Kingdom, or Switzerland, you agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Privacy Policy, or your use of Hinto (collectively, 'Disputes') will be resolved exclusively through binding individual arbitration rather than in court, except as specified below.
Arbitration Rules: Arbitration will be conducted under the rules of a mutually agreed arbitration provider (such as AAA, JAMS, or equivalent in your jurisdiction), in the English language, with a single arbitrator. The arbitrator's decision will be final and binding. The arbitration will be conducted remotely via video conference unless both parties agree otherwise.
Individual Proceedings Only; Class Action Waiver: You agree that Disputes will be arbitrated only on an individual basis and not as a class action, consolidated action, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Hinto. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
Small Claims Court Exception: Either party may bring an individual action in small claims court for disputes within that court's jurisdiction, as an alternative to arbitration.
Injunctive Relief Exception: Either party may seek injunctive or other equitable relief in court to protect intellectual property rights or confidential information.
EU/EEA/UK/Swiss Users: If you are a resident of the EU, EEA, UK, or Switzerland, this arbitration agreement and class action waiver do not apply to you. Your disputes will be resolved in accordance with the Governing Law & Venue section, and you retain all rights to bring representative actions or join class actions under applicable law.
Opt-Out Right (Non-EU Users): If you are a non-EU user, you may opt out of this arbitration agreement by sending written notice to info@hinto.dev within 30 days of your first purchase or acceptance of these Terms. Your notice must include your name, email address, purchase date, and a clear statement that you wish to opt out of the arbitration agreement. If you opt out, all Disputes will be resolved in the courts specified in the Governing Law & Venue section.
Severability: If any portion of this arbitration agreement is found unenforceable, the remainder will remain in effect, except that if the class action waiver is found unenforceable, the entire arbitration agreement will be void.
18. General
If any provision is unenforceable, the remainder will remain in effect. No waiver is implied by delay or omission in enforcing these terms.
You may not assign this Agreement without our prior written consent. We may assign in connection with a merger, acquisition, or sale of assets.
We may update these terms; the latest version will be posted with a new effective date. Continued use after the effective date constitutes acceptance. If you do not agree, you must stop using Hinto.
These terms and the Privacy Policy form the entire agreement for your use of Hinto.
19. Confidentiality
Each party will protect the other’s non-public information with reasonable care and use it only to perform under this Agreement or as required by law. Confidentiality obligations do not apply to information that is public, already known without duty, independently developed, or lawfully received from a third party.
